Starting in April, Australia will enforce a new Online Safety Code designed to combat harm linked to dating apps. The code, which was initially put into action in October 2024, aims to address safety issues in online dating, requiring platforms to take significant steps to protect users.
The initiative stems from collaboration between major dating platforms such as Tinder, Bumble, Grindr, and Hinge, along with other services like eHarmony and RSVP. The primary focus is on detecting and addressing “online-enabled harm,” defined as incidents of sexual misconduct or other severe harm stemming from interactions initiated on these platforms.
Under the new rules, dating services must implement systems to identify harmful behavior and take action, such as banning violators across all platforms operated by the company. They are also required to maintain transparent reporting mechanisms, offer resources on safe dating practices, and work closely with Australian law enforcement when there’s an immediate safety threat.
A rating system will be introduced to inform users of each platform’s compliance with the code. Additionally, dating apps will need to publish reports detailing account bans due to harmful behavior and explain their moderation practices.
Enforcement will be overseen by an independent Code Compliance Committee consisting of public representatives with expertise in online safety, law, and social networking technology. While the Australian Government lacks statutory authority to impose penalties, the committee can issue warnings or suspend apps from code accreditation.
The effectiveness of the code will be reviewed after nine months by the eSafety Commissioner, with recommendations for further action if necessary.
